ACCEPTABLE USE POLICY

This Acceptable Use Policy applies to any access to, or use of, any services made available by MWYR, LLC doing business as mwire ("mwire" "we," "us," or "our") using the website https://mwire.co/ (the "Site") or our mobile applications, and to any other related services provided by mwire (collectively, the "Services").

Please read this Acceptable Use Policy carefully before you start to use the Services. By using the Services, you accept and agree to comply with this Acceptable Use Policy. If you do not comply with this Acceptable Use Policy, mwire may terminate your access to the Site and Services without prior notice.

We may revise and update this Acceptable Use Policy from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter. If we make changes, we will let you know by revising the date at the top of the Acceptable Use Policy. Your continued use of the Site and/or Services after such posting constitutes acceptance by you of the changes.

1. Required Behavior

You must:

• Use the mwire Services solely as expressly permitted by the Terms and Conditions of Use, as authorized by mwire and only for as long as mwire permits you to continue to access the Services.
• Provide accurate and complete information when using the Services; you represent and warrant that all information you provide in screens displayed via the Services is accurate and complete in all respects.
• Keep information regarding your account(s) and wallet(s) secure and be solely responsible for any activities undertaken by persons obtaining access to your accounts and wallets, whether by your permission or because you failed to adequately secure your access information.

2. Prohibited Activities

You will not:

• Violate any law, regulation, contract, intellectual property or other third-party right, or commit a tort while using the Services;
• Purchase or transmit cryptocurrency using the Services for other than legal purposes;
• Use the Services other than for personal use, including without limitation for commercial purposes or by acting as an agent, front or go-between for any other person;
• Purchase cryptocurrency for your account using funds provided by another person;
• Knowingly allow any person who is identified as a "Specially Designated National" by the U.S. Office of Foreign Assets Control Designated to receive (either directly or indirectly) any cryptocurrency that you purchase;
• Use the Services or the services of any of our designated service providers (including without limitation Moonpay., Torus Labs Private Limited, and their respective affiliates) in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services and the services of the designated service providers, or that could damage, disable, overburden, or impair the functioning of the Services or designated service providers in any manner;
• Use any robot, spider, crawler, scraper, or other automated means or interface not provided by mwire to access the Services or to extract data from the Site or the systems of our designated service providers;
• Use or attempt to use another user's Moonpay account or Torus wallet without authorization;
• Introduce any malware, viruses, or other harmful material to the Site;
• Develop any third-party applications that interact with our Site without our prior written consent;
• Provide false, inaccurate, or misleading information;
• Engage in communications with us or via the Site that are libelous, defamatory, profane, obscene, pornographic, sexually explicit, indecent, lewd, vulgar, suggestive, harassing, hateful, threatening, offensive, discriminatory, bigoted, abusive, inflammatory, fraudulent, deceptive or otherwise objectionable;
• Act as a payment intermediary or aggregator or otherwise resell our Services on behalf of any third party;
• Use the Services to engage in what you have reason to believe are potentially fraudulent transactions;
• Use our Services in a manner that our designated service partners might reasonably believe to be an abuse of their networks or a violation of their applicable rules;
• Do, or permit or enable any third party to do, any of the following with our Services: (i) access or attempt to access our systems, programs, or data that are not made available for public use; (ii) copy, reproduce, republish, upload, post, transmit, resell, or distribute in any way material from us, our Site, or our Services;
• Permit any third party to use the Services via a rental, lease, timesharing, service bureau, or other arrangement;
• Transfer any rights granted to you under this Agreement;
• Work around any of the technical limitations, use any tool to enable features or functionalities that are otherwise disabled -- or decompile, disassemble, or otherwise reverse engineer or attempt to discover the source code of the mwire Site or Services;
• Perform or attempt to perform any actions that would interfere with the normal operation, or prevent access to or use by our other users, or impose an unreasonable or disproportionately large load on our infrastructure;
• Modify or create derivative works of the Site, Services or mwire Materials, or any portion thereof, or any data or information received by you in connection therewith;
• Frame, display or incorporate the Site, Services or mwire Materials in any website or any other work of authorship;
• Copy, imitate or use the trademarks, product or service names, logos, and other marks used in the Site or otherwise in connection with the Services, without mwire's prior written consent; or
• Encourage, induce, or enable any third party to engage in any of the activities prohibited herein.
